1. Introduction

Welcome to We Do Rentals, a South African online marketplace where suppliers can list items for rent and customers can book them conveniently. By accessing or using our website, you agree to comply with and be bound by these Terms and Conditions (“Terms”).
If you do not agree, please do not use our services.


2. Definitions

“Marketplace” means the We Do Rentals online platform available at wedorentals.co.za.

“Supplier” means an individual or business listing items for rent through the Marketplace.

“Renter” or “Customer” means a person or entity renting items through the Marketplace.

“Rental Item” means any product or equipment listed for rent on the platform.

“Booking” means an order placed by a Customer for a Rental Item.


3. Nature of Our Service

We Do Rentals is an intermediary platform that connects suppliers and renters.
We do not own, inspect, or guarantee any rental items listed on the Marketplace.
All rental agreements are between the Supplier and the Renter.
We Do Rentals is not a party to any transaction unless explicitly stated otherwise.


4. Supplier Responsibilities

Suppliers agree to:

  • Provide accurate descriptions, photos, and pricing for their rental items.
  • Ensure all rental items are safe, functional, and comply with applicable laws.
  • Honour confirmed bookings and communicate clearly about availability or cancellations.
  • Maintain valid insurance where appropriate for their equipment or assets.
  • Collect and remit applicable taxes, if required.

We Do Rentals reserves the right to remove or suspend listings that are misleading, unsafe, or violate our policies.


5. Renter Responsibilities

Renters agree to:

  • Use rented items only for their intended purpose and in a responsible manner.
  • Return items in the same condition received (reasonable wear and tear excepted).
  • Pay any applicable fees, deposits, or penalties for loss or damage.
  • Comply with any additional terms set by the Supplier.

By booking, the Renter acknowledges that the rental contract is directly between them and the Supplier.


6. Fees and Payments

  • All payments are processed securely through our payment partners.
  • We Do Rentals may charge a service fee for facilitating transactions.
  • Suppliers are responsible for any payment processing or withdrawal fees.
  • We Do Rentals is not responsible for any errors caused by third-party payment processors.

7. Cancellations and Refunds

7.1 Supplier Cancellations

If a Supplier cancels a confirmed booking, the Renter will receive a full refund. Repeated cancellations may result in account suspension.

7.2 Renter Cancellations

Renter cancellations are subject to the Supplier’s own cancellation policy (visible on each listing).
If no specific policy applies, the following default applies:

  • Cancellation 7+ days before rental start: Full refund
  • Cancellation within 7 days of rental start: 50% refund
  • Cancellation after rental start: No refund

All refunds are processed in accordance with the Consumer Protection Act (CPA).


8. Damage, Loss, and Security Deposits

Suppliers may require a refundable security deposit.
If an item is damaged or lost, the Supplier must notify the Renter and We Do Rentals within 48 hours of return.
We Do Rentals may assist in dispute resolution but is not liable for damage claims.


9. Account Registration and Conduct

Users must:

  • Provide accurate and up-to-date information.
  • Maintain confidentiality of their login credentials.
  • Not use the platform for illegal or fraudulent purposes.

We Do Rentals reserves the right to suspend or terminate accounts that violate these Terms or harm the platform’s reputation.


10. Limitation of Liability

To the maximum extent permitted by law:

  • We Do Rentals is not liable for any loss, damage, or injury arising from the use of rental items or transactions between users.
  • We provide the platform “as is” and make no guarantees about availability, quality, or suitability of rental items.
  • Our total liability under any claim shall not exceed the total service fees paid to us for that specific transaction.

11. Dispute Resolution

Disputes between Renters and Suppliers should first be addressed directly.
If unresolved, We Do Rentals may mediate at its discretion.
South African law governs these Terms, and disputes shall be resolved in the Magistrate’s Court of South Africa.


12. Privacy and Data Protection

We handle your personal information according to the Protection of Personal Information Act (POPIA).

13. Intellectual Property

All content on the We Do Rentals website (logos, designs, text, images, etc.) is owned by or licensed to We Do Rentals and may not be used without written consent.


14. Modifications

We Do Rentals may amend these Terms from time to time.
Updates will be effective upon posting to the website.
Continued use of the platform constitutes acceptance of the updated Terms.
